1. Agreement to Terms
By accessing or using CallSpoke (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
CallSpoke provides AI-powered call transcription and analysis services. We transcribe audio recordings and provide analytical insights through our web-based platform and API.
3. Account Registration
- You must provide accurate and complete information during registration
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use the Service
- One person or legal entity may maintain only one account
- You are responsible for all activities under your account
4. Acceptable Use
You agree NOT to:
- Upload content that violates any law or regulation
- Transcribe recordings without proper consent from all parties
- Use the Service to harass, abuse, or harm others
- Reverse engineer or attempt to extract our AI models
- Resell or redistribute our Service without authorization
- Transmit viruses, malware, or malicious code
- Exceed rate limits or abuse system resources
- Use the Service for any illegal purpose
5. Recording Consent Requirements
IMPORTANT: You are solely responsible for ensuring you have legal authority to record and transcribe all calls. This may include:
- Obtaining consent from all parties (required in two-party consent states/countries)
- Providing appropriate notifications that calls are being recorded
- Complying with wiretapping and recording laws in your jurisdiction
- Meeting industry-specific regulations (HIPAA, PCI-DSS, etc.)
CallSpoke is not responsible for your compliance with recording laws.
6. Intellectual Property
Your Content
You retain all rights to your uploaded recordings and resulting transcripts. By using our Service, you grant us a limited license to process and analyze your content solely to provide our services.
Our Property
The CallSpoke platform, including our AI models, algorithms, software, and documentation, are owned by us and protected by intellectual property laws.
7. Pricing and Payment
- Pricing is based on minutes of audio processed per month
- Fees are billed monthly in advance
- Overage charges apply if you exceed your plan limits
- All fees are non-refundable except as required by law
- We may change pricing with 30 days notice
- Failure to pay may result in service suspension
8. Service Level and Uptime
- We target 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- Enterprise customers receive SLA guarantees in their agreements
9. Data and Privacy
- Your use of the Service is subject to our Privacy Policy
- You are responsible for the legality of data you upload
- We implement reasonable security measures but cannot guarantee absolute security
- You should maintain your own backups of important data
10. Warranty Disclaimer
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be error-free or uninterrupted
- Transcription accuracy will meet any specific percentage
- Defects will be corrected
- The Service is free from viruses or harmful components
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLSPOKE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding fees paid in the past 12 months
12. Indemnification
You agree to indemnify and hold CallSpoke harmless from any claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of third-party rights
13. Termination
- You may cancel your account at any time from your dashboard
- We may suspend or terminate your account for Terms violations
- We may terminate with 30 days notice for any reason
- Upon termination, you must cease using the Service
- You may export your data before termination
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be announced via email or platform notification. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law provisions. Any disputes shall be resolved in the courts of [Your Jurisdiction].
16. Dispute Resolution
- Most disputes can be resolved through our support team

- No Waiver: Failure to enforce any right does not waive that right
